Pursuant to art. 13 of European Regulation no. 2016/679 (hereinafter GDPR) as well as the applicable national regulations in force, containing provisions for the protection of natural persons with regard to the processing of personal data provided to the Albergo Domus de Janas Beach Resort with the booking and execution of the requested services, we wish to inform you of the following:
Data Controller
The data controller is the company Amaduzzi S.r.l (P.IVA 00145360913) in the person of the legal representative pro tempore Carlo Amaduzzi, with registered office in Bari Sardo, Viale La Torre 24, (NU) Italy, which can be contacted at the email address info@domusdejanas.com.
Purpose of data processing
The processing is aimed at the correct and complete execution to acquire and confirm the accommodation booking and all the ancillary and requested services, for the purposes of i) a complete and correct execution of the requested services, ii) fulfillment of legal and public safety obligations, iii) fulfillment of contractual obligations arising from the commercial relationship and communications relating to the same, iv) sending promotional and marketing communications regarding our services, our promotions/offers, etc., including the sending of newsletters (occasional), through automated tools (email), upon explicit consent. v) to speed up the registration procedures in the event of your subsequent stays at our
structure. vi) to carry out the function of receiving messages and telephone calls addressed to you during your stay.
Treatment methods
The data will be processed in full compliance with the principles of lawfulness, correctness, transparency, purpose limitation and data minimization and in any case all the principles set out in art. 5 of the GDPR, subject to express consent at the bottom of this information notice. The data will be processed both by means of paper and/or electronic archives, including portable and removable devices, with the methods strictly necessary to meet the purposes set out above and in compliance with the provisions of art. 32 of the GDPR regarding security measures. The data will be processed by persons specifically appointed, but always under the authority of the data controller, in compliance with the provisions of art. 29 of the GDPR.
Legal basis for processing
The data controller will process your data lawfully as the processing is aimed at and necessary i) for the confirmation, execution and performance of the services requested during your stay and for the execution of the services adopted and/or for the execution of pre-contractual measures adopted upon request, ii) for the pursuit of the legitimate interest of the data controller, including, for example, marketing, iii) for the correct fulfillment of legal obligations (including administrative, accounting and tax) incumbent on the data controller as well as iv) whenever the same processing is based, as in this case, on your express consent.
Consequences of failure to communicate personal data
Failure to communicate personal data prevents the completion of the contract and any relationship based on it, of the services, of the stay at Albergo Domus de Janas Beach Resort; their incorrect or partial communication may jeopardize the correct execution of the same and the achievement of the results sought.
Data retention
Personal data will be retained for the entire duration of the stay and in any case, even subsequently, for the time necessary to achieve the purposes described and in any case in which the data controller will be subject to legal obligations of retention (10 years and even longer in the case of tax audits). It is specified that the data acquired for the purpose of: sending promotional and marketing communications regarding our services, our promotions/offers, etc.; to speed up the registration procedures in the event of your subsequent stays at our facility; to carry out the function of receiving messages and telephone calls addressed to you during your stay, are retained by us for a maximum period of 10 years.
Data communication
Personal data may be disclosed between the data controller and the data subject and vice versa, adopting security measures previously requested and agreed upon with the latter, and in any case using methods that guarantee a reasonable level of security and confidentiality in relation to the nature of the data. Furthermore, for the performance of their assigned functions, i) compliance with legal obligations; ii) employees authorized and supervised by the Data Controller; iii) intermediary collaborators who provide assistance and consultancy to our Hotel in marketing matters, for example in communications; iv) management of requests and bookings for non-hotel services exclusively at the data subject’s request, such as excursion bookings; v) in the event of a medical emergency. The subjects listed above may also be domiciled outside the territory of the European Economic Area. vi) collaborators, intermediaries, domiciliary colleagues and/or consultants, IT technicians and/or storage service providers, including those with facilities located entirely or partially outside the European Economic Area, data digitization, archiving, collection, printing, and shipping services, and email management companies, as well as accountants, lawyers, or other professionals who provide services functional to the execution of the contract itself and in any case for tax purposes and for other purposes required by law; banking and insurance institutions that provide services functional to the purposes mentioned above; and entities that process data in compliance with specific legal obligations, including competent authorities to fulfill legal obligations upon specific request. The subjects listed above may also be domiciled outside the territory of the European Economic Area.
Profiling and dissemination of data
Personal data are not subject to dissemination and profiling, except for necessary communications that may involve the transfer of data to public bodies, consultants or other parties, including as external data controllers, for the fulfillment of legal obligations or to institutions to which the communication is useful for the purposes of executing the contract, providing services and/or other purposes envisaged for the processing.
Video surveillance
In the premises, offices and exteriors of the Hotel Domus de Janas Beach Resort Studio, for reasons of safety and protection of people and property, for purposes of fire prevention and safety of company property and work, video surveillance and recording devices identifiable by special signs are installed. The recorded images are deleted after 24 hours, except on holidays or in other cases of closure of the business, and in any case no later than 7 days. They are not communicated to third parties except by reasoned act of the judicial authority and only in the cases and ways provided by law.
Rights of the interested party
The rights provided by the GDPR for the interested parties are those of:
– requesting and obtaining from the data controller i) access to their personal data, ii) the rectification of inaccurate data or the integration of any incomplete data, iii) the deletion of personal data if one of the conditions referred to in art. 17, paragraph 1 of the GDPR occurs or iiii) the limitation of the processing of your personal data in the event of one of the hypotheses referred to in art. 18, paragraph 1 of the GDPR;
– oppose at any time to the further processing of your personal data in the event of particular situations that concern you, without prejudice to the lawfulness of the processing carried out previously and of the further processing necessary for the owner to assert his rights and demonstrate the correctness of his action towards the interested party;
-revoke consent at any time if the same has been given for one or more specific purposes and concerns so-called common personal data (date and place of birth, place of residence or domicile, etc.), without prejudice to the lawfulness of the processing carried out previously and of the further processing necessary for the owner to assert his rights and demonstrate the correctness of his action towards the interested party;
– lodge a complaint with the competent Data Protection Authority in the relevant European Union country.
